THEWASHBOARD.ORG SCHOLARSHIP VIDEO CONTEST OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
SCHOLARSHIP CONTEST DESCRIPTION: TheWashBoard.org scholarship video contest (the “Contest”) is sponsored by College Spark Washington, which operates theWashBoard.org, located at 190 Queen Anne Avenue N., Suite 260, Seattle, WA 98109, Scholarship Junkies located at P.O. Box 45406, Seattle, WA 98145, and NELA Center for Student Success in Washington located at 309 23rd Avenue S., Seattle, WA 98144 (each a “Sponsor,” together “Sponsors”). The object of the contest is to inspire continued engagement among scholarship seekers in Washington state and to bring greater attention to the sponsors’ respective scholarship resource presence on social media platforms. TheWashBoard.org and Scholarship Junkies know that students in Washington state are working hard to find scholarships and share their story, so they want to encourage students to continue this by using their creativity and ingenuity to create original videos answering: Why are scholarships important to you?
ELIGIBILITY: TheWashBoard.org scholarship video contest (the “Contest”) is open to all high school seniors and current undergraduate students in the state of Washington or Washington residents who will be enrolled at least part-time in an accredited university or college (2-year or 4-year) during the 2012-2013 academic year. Minors under the age of 18 years old can participate but need their parent or guardian’s written permission and authorization. Employees, officers, and directors (including immediate family members (spouse, parent, child and sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of the Sponsors and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Contest are not eligible to participate or win a prize. The Contest is subject to all applicable federal, state, and local laws, rules and regulations. Void where prohibited or restricted by law, rule or regulation.
HOW TO ENTER: The Contest begins at 8:00 am PST on December 15, 2011, and ends at 11:59 pm PST on January 31, 2012 (“Entry Period”). During the Entry Period, there is one (1) way to enter: online via www.thewashboardcontest.org. No other method of entry will be accepted. During the Entry Period, go to www.thewashboard.org and click on the banners, buttons and/or links to access the online entry page for the Contest. Then follow the provided instructions to complete and submit the entry form, which includes your name, address, city, state, zip code, telephone numbers (day and evening), email address, age of entrant, signature and email address of parent/guardian (if entrant is under the age of 18) (“Entry Information”). As a part of your Entry, you will also be required to submit an original video answering the question “Why are scholarships important to you?” The video does not need to be in English; however, if you film in a language other than English, you must include English subtitles. Videos must not contain any copyrighted music for which you do not have express written consent to use in your video (royalty free music is acceptable) and must be uploaded to YouTube or Vimeo. The link (url) to your video must be submitted in the corresponding field on the online entry form. Video must be no longer than 60 seconds in length. The video and the Entry Information shall be collectively referred to herein as the “Entry.” By submitting your completed entry form as directed, you will be eligible for the Contest. Videos submitted online become the property of the Sponsor.
Limit one (1) Entry per person. Group entries are allowed up to three (3) participating members. All Entries become the property of Sponsors and will not be acknowledged or returned. The same person may not submit multiple Entries. Multiple Entries received from any person or e-mail address or household in excess of the stated limitation will be void and only the first eligible Entry received from such person or household will be eligible for Entry. You must have the permission of any person that appears or is identified in your Entry, however only the primary entrant(s) is/are eligible to win the prize. Your Entry must be original, truthful, unpublished, and created solely by the submitting entrant. In case of a dispute over the identity of an entrant who submitted a potentially winning Entry, Sponsors reserve the right to deem that the Entry was submitted by the registered subscriber of the email address submitted at the time of Entry.
By entering, you represent and agree that you created the video and you have required permissions to submit your Entry to the Contest subject to the terms of these Official Rules. There must not be any proprietary background containing artwork or recognizable commercial logos, or any inappropriate or offensive materials containing violence, pornography or offensive/obscene language in the Entry. Entries that are incomplete, illegible, garbled, late, damaged, or corrupted are void and will not be accepted. By entering, you agree that the video and any other portion of the Entry, may be broadcast by Sponsors and used in promotions and advertisements for Sponsors.
By entering the contest, entrant grants Sponsors the non-exclusive, royalty-free, and irrevocable right to use, reproduce, copy, publish, display, distribute, perform, translate, adapt, modify, edit (including for length) and otherwise exploit the video (and any portion thereof) and any other portion of the Entry and to incorporate it in other works in any and all markets and media now or hereafter known worldwide in perpetuity without additional compensation, notification, permission or approval. Entrants warrant that they have the sole and exclusive right to grant such rights to Sponsors and that Sponsors’ reproduction, publishing, displaying, and/or other use of their Entries, or any portions thereof will not infringe on any rights of third parties, including without limitation, copyright, trademark, defamation, privacy, or publicity, or create claims for false light, idea misappropriation, intentional or negligent infliction of emotional distress, or breach of contract. Any Entry containing material that is violent, pornographic, obscene, illegal, inappropriate, or racially or morally offensive or that does not comply with these Official Rules or meet Sponsors’ standards for any reason, as determined by Sponsors in their sole discretion, will be rejected as ineligible for consideration. Entries must comply with all applicable laws, rules, and regulations. Entrants also warrant that they have obtained written permission when filming on private property not owned or controlled by entrant, where such permission is required. Upon request, entrant must provide Sponsors with signed releases from the owners of any private property where filming occurred. Sponsors shall have no obligation to copy, publish, display, or otherwise exploit the Entry.
Sponsors expressly reserve the right to post on their websites and/or play in any marketing materials a shorter version, selected and/or edited by the Sponsor(s) in its sole discretion, of the video submitted. Entrants will have no right of review, notice, or approval of the content in the video posted on the Sponsors’ websites or played in any marketing material. All information submitted online by entrants is subject to, and will be treated in a manner consistent with theWashBoardContest.org’s Terms and Conditions accessible at http://thewashboardcontest.org/terms, and Privacy Policy accessible at http://thewashboardcontest.org/privacy (both of which are incorporated herein by reference). Entrants must fully complete and submit all non-optional data requested on the online entry form to be eligible. Incomplete entries are void.
JUDGING: Representatives of theWashBoard.org and Scholarship Junkies as well as select community members will judge all eligible entries received during the Contest Entry Period based equally on the following judging criteria: originality (32.5%), creativity (32.5%), and the ability to express their answer to the contest question in a positive manner (35%) (“Judging Criteria”). On or about February 29, 2012, the entrant(s) who submitted the entry with the highest score based on these criteria, as determined by the judges in their sole discretion, will be the First Place Winner(s) (the “Winner/Winners”), subject to verification of eligibility and compliance with the terms of these Official Rules. The selection and review process may occur on a rolling basis as Entries are received. In the event that a group submission is selected as the Winner/Winners, the Prize shall be evenly distributed between the two (2) or three (3) eligible group members. In the event of a tie, an additional, tie breaking judging will determine the Winner from among such tied entries using the judging criteria outlined herein. Sponsor reserves the right to not award the prize if, in its sole discretion, it does not receive a sufficient number of eligible and qualified entries. The decisions of Sponsor are final and binding on all matters relating to this Contest. Odds of winning depend on the total number of eligible entries received. Limit one (1) Prize per person.
PRIZES: A Prize(s) of up to $3,000 is available to be awarded. Winner(s) will receive up to three thousand dollars in scholarship awards to be used for educational purposes at an accredited university or college during the 2012-2013 academic year (the “Prize”). In the event a group entry is selected as the Winner, the Prize will be divided evenly among the number of eligible group members ($1,500 each for two group members or $1,000 each for three group members) (Approximate Retail Value of Prize (“ARV”): $3,000). Winner is fully responsible for any and all applicable federal, state, and local taxes (including income and withholding taxes). All prize details are at Sponsors’ sole discretion. Any unused portion of the scholarship award must be returned to the Sponsor.
Scholarship awards will be sent directly to the college or university at which the winner(s) will be matriculated during the 2012-2013 academic year. The Prize is non-transferable and non-assignable, with no cash redemptions or substitutions except at Sponsors’ sole and absolute discretion. Sponsors reserve the right to substitute a prize (or portion thereof) with one of comparable or greater value, at their sole and absolute discretion.
NOTIFICATION: The potential Winner will be notified by e-mail, mail and/or telephone
(in the sole discretion of Sponsors, as applicable) by the Sponsors. Two (2) attempts will be made to notify the Winner at the phone number and/or email address submitted at the time of Entry. In the event that any potential Winner does not respond to any such notification within three (3) days of date of issuance, a disqualification will result, the Prize will be forfeited and, at Sponsors’ sole discretion and time permitting, an alternate potential Winner may be chosen from among all remaining eligible entries. The potential Winner may be required to submit his/her valid social security number (if applicable) and/or other identification to Sponsors and will be required to execute, have notarized and return an Affidavit of Eligibility and Release of Liability and, unless prohibited by law, Release of Publicity (collectively “Contest Documents”), within five (5) days of date of issuance. Noncompliance within this time period will result in a disqualification, the Prize will be forfeited and, at Sponsors’ sole discretion and time permitting, an alternate potential Winner may be selected from among all remaining eligible entries if all required documents are not properly executed and returned within the specified period of time. Refusal or return of such documents as non-deliverable or potential Winner’s noncompliance with these Official Rules will also result in disqualification and prize forfeiture and, at Sponsors’ sole discretion and time permitting, may cause an alternate potential Winner to be selected from among all remaining eligible entries.
The decisions of the Judges and Sponsors are final and binding. Entrants agree that Sponsors may record Sponsors advising he/she that he/she has been selected as the Winner in Sponsors’ sole discretion. Sponsors reserve the right to make public personal information (e.g., name, hometown, etc.) about the Entrants and/or Winner on the website prior to, during, or following the Contest.
WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Contest and submitting an entry, each entrant agrees to (i) be bound by these Official Rules, including all entry requirements, and (ii) waive any and all claims against the Sponsor, and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Contest, and all of their respective officers, directors, employees, agents and representatives (collectively, “Released Parties”) for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the entrant’s participation in the Contest or from the receipt or use of any Prize or any travel or activity related to the receipt or use of any Prize. The Winner, by acceptance of Prize, grants to Sponsors and each of their respective designees the right to publicize such Winner’s name, address (city and state of residence), photograph, voice and/or other likeness and prize information in any and all media now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration, notification or permission, unless prohibited by law.
GENERAL CONDITIONS: Released Parties are not responsible for stolen, late, incomplete, illegible, misdirected, lost, damaged, garbled, delayed, undelivered, inaccurate, postage-due or garbled entries, e-mail or mail. Entries submitted by a script, macro or other mechanical or automated means or by any means which subvert the entry process will be disqualified. Released Parties are not responsible for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the Winner or in any Contest related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Contest or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Contest or website or attempt to undermine the legitimate operation of the Contest by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or Sponsors’ representatives or who are in violation of these Official Rules, as solely determined by Sponsors, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the Sponsor and/or their respective agents. Sponsors shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Contest, and to resolve all disputes in their sole discretion. Released Parties (i) make no warranty, guaranty or representation of any kind concerning any Prize, and (ii) disclaim any implied warranty. All disputes will be resolved under applicable U.S. laws in the County of King, state of Washington without giving effect to choice of law or conflict of law principles (whether of the state of Washington, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Washington. Sponsors’ failure to enforce any terms of these Official Rules shall not constitute a waiver of that provision.
The Sponsors, as applicable, reserve the right, in their sole discretion, to cancel or suspend the Contest for any reason, including should virus, bugs, unauthorized human intervention, or other causes corrupt the administration, security, fairness, integrity or proper operation of the Contest. In the event of cancellation, Sponsors may elect to identify the Winner and award the Prize by way of an alternate winner in the same manner and using the same judging criteria as the original winner he from among all non-suspect, eligible entries received up to the time of such cancellation.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS WILL DISQUALIFY ANY SUCH ENTRANT AND SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
All online entries must include a valid e-mail address for the entrant. In case of multiple entries received from any person or e-mail address or household, only the first entry received from such person, e-mail address or household will be considered. In the event of a dispute as to the identity or eligibility of a Winner based on an e-mail address, the winning entry will be declared made by the “Authorized Account Holder” of the e-mail address submitted at the time of entry provided he/she is eligible according to these Official Rules. The “Authorized Account Holder” is defined as the natural person to whom the applicable Internet service provider or other organization (such as a business or educational institution) has assigned the e-mail address for the domain associated with the submitted e-mail address. Sponsors reserve the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest.
WINNERS’ LIST: For notification of the identity of the Winner/Winners (available after March 1, 2012), mail a self-addressed stamped envelope to: TheWashBoard.org Scholarship Video Contest Winners, Scholarship Junkies, P.O. Box 45406, Seattle, WA 98145. Requests for notification must be received by March 15, 2012.
